Terms and Conditions - THIENEL Dental e.K.

These general terms and conditions are valid for all services of the company THIENEL Dental e.K. We will not accept any conditions contradictory to or de-viant from our general terms and conditions and herewith contradict these explicitly.

All prices are subject to confirmation.

Delivered goods shall remain property of THIENEL Dental e.K. until complete payment. Adverse to companies the reservation of title extends all delivered goods until any and all claims of THIENEL Dental e.K. arising under its business relationship with customer have been fully paid.

Tools or appliances that are needed for manufacturing of customized goods and which are  made due to customers order remain property of THIENEL Dental e.K. and will not be delivered to the customer. This also applies in case of seperate in-voicing of such tools and appliances. The customer takes the responsibility that rights of third parties particularly copyrights or industrial property rights are not being violated by proceeding and disposition of his order due to customized specification, design or private label. The customer indemnifies THIENEL Dental e.K. against third party claims caused by possible violation of those rights. 

THIENEL Dental e.K. shall not be liable for damages caused by slightly negligent breach of duty, on whatever legal grounds. The aforesaid limitation of liability shall not apply to liability for personal injuries.

Customers warranty rights shall require that he inspects the goods immediately upon delivery and notifies THIENEL Dental e.K. thereof in writing and without undue delay.

The law of the Federal Republic of Germany is applicable to the exclusion of UN-Convention of Contracts for the International Sale of Goods - CISG. Jurisdiction for all legal disputes is Dresden.
